PURPOSE:

To consider the abandonment of a section of public right of way known as Snapfinger Road in Land Lot 126 of the 15th District adjacent to 2349, 2317, and 2610 Snapfinger Road, Decatur, GA 30034.   

 

NEED/IMPACT:

The owner of property located at 2349, 2317, and 2610 Snapfinger Road, Decatur, GA 30034 has submitted a public right of way abandonment petition for an abutting 35,915 SF section of right of way, known as Snapfinger Road, to cease to be used by the public to the extent that no substantial public purpose is served by it.

Staff has reviewed and determined that the section of the county road system has ceased to be used by the public to the extent that no substantial public purpose is served by it and shall no longer be part of the county road system and the rights of the public in the section of road as a public road shall cease.

State law requires that a public hearing be held on a potential abandonment of right of way. This public hearing has been advertised for two consecutive weeks in the Champion Newspaper and owner has obtained consent from the adjacent property owners in the affected area.

The County Attorney’s Office has reviewed the attached resolution and has approved it as-to-form.

 

FISCAL IMPACT:

There is no fiscal impact.

 

RECOMMENDATION:

Recommended Action

Adopt the attached resolution abandoning a section of public right of way known as Snapfinger Road and authorize the Chief Executive Officer to execute all necessary documents.
