PURPOSE:

To consider the abandonment of a 354 SF (0.0084-acres) section of public right-of-way known as Chestnut Street and a 127 SF (0.0029-acres) section of alleyway adjacent to 286 Third Avenue, Scottdale, GA 30317. 

 

NEED/IMPACT:

The owner of property located at 286 Third Avenue, Scottdale, GA 30317 has submitted a public right of way abandonment petition for an abutting 354 SF section of right of way known as Chestnut Street and a 127 SF section of alleyway to cease to be used by the public to the extent that no substantial public purpose is served by it.

Staff has reviewed and determined that the sections of the county road system have ceased to be used by the public to the extent that no substantial public purpose is served by it and shall no longer be part of the county road system and the rights of the public in the section of road as a public road shall cease.

State law requires that a public hearing be held on a potential abandonment of right of way. This public hearing has been advertised for two consecutive weeks in the Champion Newspaper and notices have been sent adjacent property owners in the affected area.

The County Attorney’s Office has reviewed the attached resolution and has approved it as-to-form.

 

FISCAL IMPACT:

There is no fiscal impact.

 

RECOMMENDATION:

Recommended Action

Adopt the attached resolution abandoning public rights of way adjacent to 286 Third Avenue and authorize the Chief Executive Officer to execute all necessary documents.
