PURPOSE:
DeKalb County received notice from the City of Atlanta dated April 15, 2024 of its intent to act on Steven Jones’ annexation petition seeking annexation of approximately 23 acres of land in unincorporated DeKalb County on Fayetteville Road, Flat Shoals Road and in the Collection at East Lake townhome community into the City of Atlanta via the sixty percent (60%). The Board of Commissioners authorized an objection to the annexation on May 28, 2024, which was sent to the City and Department of Community Affairs on May 30, 2024. On June 18, 2024, the County received correspondence from the City Clerk clarifying that the City has not accepted or verified Mr. Jones application for annexation, meaning the County’s ability to object to the annexation and begin the dispute process has not been triggered. Withdrawal of the County’s objection will terminate the untimely dispute process

Recommended Action
Vote to withdraw the County’s May 30, 2024 objection to the annexation of approximately 23 acres into the City of Atlanta pursuant to the annexation petition filed by Steven Jones; and to authorize a withdrawal to be sent to the City of Atlanta and the Department of Community Affairs in a form acceptable to the County Attorney, and authorize the County Attorney, or her designee, to execute all necessary documents
