PURPOSE:

Application of Glen Wylie c/o Battle Law, P.C. for a Major Modification of zoning conditions pursuant to CZ-19-1243269 to amend an approved site plan with a new parking lot that is closer to the property line, within Tier 2 of the I-20 Overlay and M (Light Industrial) zoning district. STAFF ANALYSIS: The property currently contains a warehouse/distribution facility and falls within a Light Industrial (LIND) Character Area. The property is zoned M (Light Industrial) with four zoning conditions approved by the Board of Commissioners on July 23, 2019 per Rezoning Case Z-19-1243269 (see attached). The applicant is proposing to modify condition #1 to change the site plan to allow truck parking to be located 10-feet closer to the Clifton Springs Road right-of-way to continue its current use as distribution facility more efficiently. Based on the submitted information, there will be no net increase in the number of parking spaces provided (25 spaces), but the new layout will enhance traffic flow within the site by separating the trucks from the employee parking. Based on the submitted information the proposed parking lot revision complies with minimum open space requirements (min 20% required and 34% provided) and parking space dimension requirements (minimum 12- ft wide by 55- ft long spaces required, 12- ft wide by 60- feet long parking spaces provided) of the Zoning Ordinance. The Transportation Department has reviewed the request and has no objections. Additionally, no changes are proposed to the current building or the warehousing/distribution land use. The applicant is proposing a conceptual landscape plan and rendering to comply with Condition #2 which requires a 15-foot-wide landscape strip with screening trees along Clifton Springs Road and Panthersville Road (see attached). It appears that the proposed modification request is consistent with the policies and strategies of the Light Industrial (LIND) Character Area to encourage warehouse distribution and industrial uses (Light Industrial Character Area, 2050 Comprehensive Plan, page 51). Given the above information, it appears that the request is consistent with the Comprehensive Plan, compatible with surrounding uses, and would not create a burdensome use of existing streets and transportation facilities based on Sec 7.3.5 A, B, and G of the Zoning Ordinance. Therefore, the Planning & Sustainability Department recommends “Approval, with Staff’s recommended conditions”.

 

PLANNING COMMISSION VOTE: Approval with Conditions 9-0-0.  Jon West moved, Vivian Moore seconded for approval with four (4) conditions, per Staff recommendation.

 

COMMUNITY COUNCIL VOTE/RECOMMENDATION:  Approval 8-1-0.
