PURPOSE:

To consider approval of a Consent to Leasehold Mortgage and Security Agreement under DeKalb County Contract No. 2025-100117 with Aero Center PDK West, LLC with an address of 1961 Sixth St; and

To consider authorizing the Chief Executive Officer to execute the Consent to Leasehold Deed to Secure Debt and Security Agreement, and any other documents recommended by the County Attorney.

 

NEED/IMPACT:

Approval of the Consent to Leasehold Mortgage and Security Agreement will allow the County to maintain the revenue generating stability of the ground lease. The Lessee’s financial obligation to the County will neither increase nor decrease.

 

The County Attorney has reviewed the documents and approved them as to form pending Governing Authority

approval.

 

The Consent to Leasehold Mortgage and Security Agreement does not require briefing by the Airport Advisory

Board.

 

FISCAL IMPACT:

This is a revenue generating Lease Agreement. There is no cost to the County.

 

RECOMMENDATION:

Recommended Action

To approve the Consent to Leasehold Mortgage and Security Agreement and authorize the chief executive officer to execute all necessary documents in a form acceptable to the County Attorney.
