PURPOSE:
To consider approval of Consent to Assignment to Contract No. 07-800323 by U. S. Transport, Inc., to The Maintenance Group, LLC dba Elliott Aviation of Atlanta, LLC; and
To consider authorizing the Chief Executive Officer to execute the Consent to Assignment.
NEED/IMPACT:
The Lessee, U. S. Transport, Inc., desires to assign and transfer all of its rights, title and interest in and to its long-term ground lease to The Maintenance Group, LLC dba Elliott Aviation of Atlanta, LLC, a Georgia limited liability company. The Maintenance Group, LLC dba Elliott Aviation of Atlanta, LLC, desires to accept the assignment and transfer of the lease, as a result of a purchase agreement between U. S. Transport, Inc. and The Maintenance Group, LLC dba Elliott Aviation of Atlanta, LLC.
Approval of the Consent to Assignment will allow the County to maintain the revenue generating stability of the ground lease. The Lessee's financial obligation to the County will neither increase nor decrease.
The DeKalb Peachtree Airport Advisory Board on September 9, 2024, approved the Consent to Assignment by a vote of 5-0.
The County Attorney has reviewed the document and approved it as to form pending Governing Authority approval.
FISCAL IMPACT:
This is a revenue generating lease agreement. There is no cost to the County.
