PURPOSE:
To consider the abandonment of a 26,090 SF (0.59-acres) section of unimproved public right-of-way known as Elam Road.
NEED/IMPACT:
The abandonment of this public right of way is being considered as it is no longer needed for public access or infrastructure purposes. Conveying the property to the adjacent owner will facilitate more efficient land use and eliminate any maintenance responsibilities for the County. The proposed action aligns with land management objectives and ensures that surplus public property is returned to productive use.
Staff has reviewed and determined that the subject section of the county road system serves no substantial public access or infrastructure purposes. No adverse impacts to public access, utilities, or traffic circulation are anticipated.
State law requires that a public hearing be held on a potential abandonment of right of way. Public hearing notices have been advertised for two consecutive weeks in the Champion Newspaper and the Petitioner owns all adjacent parcels affected by the abandonment.
The County Attorney's Office has reviewed the attached resolution and has approved it as-to-form.
FISCAL IMPACT:
The proposed abandonment sold at its determined fair market value will generate $7,827 in revenue from the conveyance of the subject area. This transaction removes future maintenance obligations, returns surplus public property to productive use, and adds it back to the tax roll.
