PURPOSE:
To protect the public health from sanitary sewer spills and minimize the impact to the publicly owned treatment works (POTW).
NEED/IMPACT:
The County has a current FOG Ordinance, which addresses food service establishments’ discharge of FOG, and the Industrial Pretreatment Program, which places permit limits on FOG discharges from commercial /industrial operations. However, on research, following a prolonged period of “no tolerance” of violations in the permits, multi-family housing was identified as a currently unregulated source of FOG impacting the POTW. During stakeholder meetings, the multi-family housing representatives preferred the option of regulation under a revised FOG Ordinance rather than under the existing Industrial Pretreatment Program, which regulates any commercial operation.
FISCAL IMPACT:
No direct impact to the County. FOG permit and review fees are designed to cover the cost of the FOG program. Other activities such as investigation and documentation required to implement a trigger are already required under the Consent Decree and routine maintenance activities of the system.

Recommended Action
Adopt the ordinance and authorize the chief executive officer to execute all necessary documents.
