PURPOSE:
To consider approval of Lease Amendment No. 2 to Contract No. 531981 with Flightway One, LLC. Lease Amendment No. 2 extends the Lease Agreement term for five years until December 20, 2029; and
To consider authorizing the Chief Executive Officer to execute the necessary documents.
NEED/IMPACT:
The County executed County Contract No. 531981 with Flightway One, LLC on December 20, 2004. The lease contains one prior amendment. Lease Amendment No. 2 was negotiated in accordance with the DeKalb County Code and accomplishes the following in part:
* Provides for a five-year extension of the term in accordance with Section B, Option Period.
* Includes a current survey of North Terminal Lease Area N6 (2011 Flightway Drive).
* Establishes the monthly rent in accordance with the current Fair Market Value of the leasehold.
* Increases the monthly fuel flowage commission to $0.16 per gallon for fuel, oil and lubricants delivered to the leased property.
Approving Lease Amendment No. 2 to County Contract No. 531981 will benefit the County and the Airport and inure to the public interest by enabling the Lessee to attract additional users over an additional five years which will add revenue to the County via personal property tax and increase the amount of fuel and sales tax paid to the County.
The County Attorney has reviewed the document and approved it as to form pending Governing Authority approval.
The DeKalb Peachtree Airport Advisory Board at their meeting on August 12, 2024, approved Lease Amendment No. 2, by a vote of 4-0.
