PURPOSE:
State law allows counties to object to annexations under certain circumstances. DeKalb County received notice from the City of Brookhaven dated August 21, 2024 of its intent to act on a proposed annexation petition via the one hundred percent (100%) method submitted by ArcOne Construction Company. The Petition seeks to annex 1481 Lavista Road, Atlanta, Georgia 30324 into the City of Brookhaven. The County Attorney and relevant County staff are investigating grounds for an objection to the proposed annexation. An authorizing Resolution is attached to this item. The County anticipates providing the elected officials with a substitute item containing specific grounds for the objection for adoption and approval at the Committee of the Whole meeting on September 24, 2024.

RECOMMENDATION:
Recommended Action
Vote to adopt the attached Resolution and object to the proposed annexation of 1481 Lavista Road into the City of Brookhaven pursuant to the annexation petition filed by ArcOne Construction Company; and to authorize an objection to be sent to the City of Brookhaven in a form acceptable to the County Attorney, and authorize the Chief Operating Officer, or his designee, to execute all necessary documents.
