PURPOSE:

To amend the Declaration of Easement Agreement dated March 30, 2007, and recorded on May 2, 2007, in Deed Book 19908, page 729 between VSI Decatur, LLC and DeKalb County Government for the purpose of providing clarity and avoidance of confusion regarding the access easement area known as the Fiber Optic Property, located in Land Lot 170 of the 15th District of DeKalb County, Georgia and further described as 1856 Eastfield Street, Decatur, GA 30032 (Parcel ID: 15-170-13-126).

 

NEED/IMPACT:

The County has not installed any fiber optic cables or utility lines in, under or over the Fiber Optic Property and the County is amendable to the Fiber Optic Property being developed, maintained and used by the owner of the adjacent property located at 1816 Candler Road, Decatur, GA 30032. The County is also amenable to releasing a portion of its ingress and egress easement to allow development of the adjacent property.

None.

 

RECOMMENDATION:

Recommended Action

Approve the Amended Declaration of Easement Agreement and authorize the Chief Executive Officer to execute all necessary documents in a form acceptable to the County Attorney.
