PURPOSE:
State law allows counties to object to annexations under certain circumstances. DeKalb County received notice from the City of Avondale Estates dated August 8, 2024 of its intent to act on a proposed annexation petition via the one hundred percent (100%) method submitted by Overlook at Avondale, LP. The Petition seeks to annex 718 Dalerose Avenue and 717 Brown Place, Decatur, Georgia 30030 into the City of Avondale Estates. The County Attorney and relevant County staff are investigating grounds for an objection to the proposed annexation. An authorizing Resolution is attached to this item. The County anticipates providing the elected officials with a substitute item containing specific grounds for the objection for adoption and approval at the Committee of the Whole meeting on September 17, 2024.

RECOMMENDATION:
Recommended Action
Vote to adopt the attached Resolution and object to the proposed annexation of two parcels into the City of Avondale Estates pursuant to the annexation petition filed by Overlook at Avondale, LP; and to authorize an objection to be sent to the City of Avondale Estates in a form acceptable to the County Attorney, and authorize the Chief Operating Officer, or his designee, to execute all necessary documents.
