PURPOSE:

To formally abandon an unused infrastructure easement located on 3775 and 3777 Ashford Dunwoody Rd., Atlanta, DeKalb County, GA 30319, on the eastern side of the Nancy Creek Tributary, pursuant to a settlement agreement dated March 12, 2026, related to those properties.

 

NEED/IMPACT:

To satisfy an obligation to abandon an unused infrastructure easement under the settlement agreement in the Carolyn Rountree v. DeKalb County litigation.

RECOMMENDATION:

Recommended Action

Approve the abandonment of an unused infrastructure easement located on 3775 and 3777 Ashford Dunwoody Rd., Atlanta, DeKalb County, GA 30319, on the eastern side of the Nancy Creek Tributary (while retaining the County’s infrastructure and easement rights on the western side of the Nancy Creek Tributary), and authorize the CEO to execute a formal Easement Abandonment Agreement in a form acceptable to the Interim County Attorney...Recommended Action.
