PURPOSE:

To terminate the current Easement and enter into a construction agreement with Decatur East Phase II, LP. The developer, Decatur East Phase II, LP, will construct necessary infrastructure on the new easement area granted by MARTA in a previous item. The new access easement will allow County employee to access 178 Sams Street, Decatur, GA 30030. The attached agreement terminates the easement after certain conditions are met, and obligates Decatur East Phase II, LP to construct a new access tract on behalf of the County, at the developer’s expense.

 

NEED/IMPACT:

DeKalb County, if it accepts the grant of a new access easement from MARTA, will need to terminate its former easement in order to facilitate the construction of the curb cut to be paid for by Decatur East Phase II, LP.

 

FISCAL IMPACT:

There is no fiscal impact associated with this item.

Approve and Accept the attached Agreement and Easement Termination and to authorize the Chief Executive Officer to execute all necessary documents.
