PURPOSE:
To consider entering into an intergovernmental agreement with the City of Clarkston for construction and maintenance of sidewalk on the south side of East Ponce de Leon Avenue and Church Street from Brockett Road to the Church Street railroad crossing;
To consider entering into a land lease agreement with CSX Transportation for this sidewalk; and
To consider authorizing the Chief Executive Officer to execute all necessary documents for this project.
NEED/IMPACT:
The City of Clarkston is proposing to construct sidewalk on the south side of East Ponce de Leon Avenue and Church Street within CSX Transportation right-of-way. This proposed sidewalk is partially in the City of Clarkston and partially in unincorporated DeKalb County. Under the terms of the proposed intergovernmental agreement, the City of Clarkston will construct the sidewalk, including in unincorporated DeKalb County, and be responsible for all construction related costs. The City of Clarkston will also be responsible for future maintenance of the sidewalk constructed under this agreement. DeKalb County will sign a land lease agreement with CSX Transportation and be responsible for payment of the annual license fee which is currently $1,200.00.
FISCAL IMPACT:
No immediate cost, but there will be an annual license fee which is currently $1,200.00. The fee will be paid from the Public Works-Transportation operating budget.
