PURPOSE:
DWM request is seeks to increase the agreement term through December 31, 2024, approval of this request will allow DeKalb County Government and the commission additional time to negotiate and approve a renew the multi-state legal action related to the County's water supply use of the Chattahoochee River as the source of the supply of water provided to customers by approving the Cooperative Technical Assistance Intergovernmental Cost Sharing Agreement between the City of Atlanta, the Cobb County - Marietta Water Authority, DeKalb County, the Atlanta - Fulton County Water Resources Commission, Gwinnett County and the Atlanta Regional Commission (ARC). Awarded by the BOC March 22, 2022 for an amount of $200,000 then change order for additional $400,000 on March 28, 2023.

NEED/IMPACT:
To perform work and legal research to carry out certain technical assistance activities whereas the States of Alabama, Florida and Georgia, and the U. S. Army Corp of Engineers are involved in disputes regarding the states respective water rights in the Apalachicola-Chattahoochee-Flint River Basin (the ACF Basin) and the Alabama-Coosa-Tallapoosa River Basin (the ACT Basin). Failure to properly carry out this defense could result in significant changes or loss of the volume of water required by the County both now and in the future. The Contract is multi-jurisdictional and needs to be executed by all parties to proceed.
