Title

Commission District(s): All Districts

A Request for the Director of Planning & Sustainability to amend the DeKalb County Nuisance Ordinance to Add a Closure of Chronic Nuisance Properties Ordinance Chapter.

Body

Information Contact: Commissioner Robert Patrick

Phone Number: 404-371-3052

PURPOSE:

Recommended changes to add a chapter to the Nuisance Ordinance to include Closure of Chronic Nuisance Properties Ordinance to authorize the municipal court to order the abatement of a public nuisance established as a result of violent conduct or crime occurring with certain properties through the immediate closure of such properties ; to require the municipal court to order the abatement of such a public nuisance through the immediate closure of such properties where the municipal court has determine such a public nuisance to have occurred twice regarding the same property within eighteen months; and for other purposes

NEED/IMPACT:

The proposed Closure of Chronic Nuisance Properties Ordinance addition prevents further violent crimes from occurring at known properties associated with such crimes. Furthermore, it will strengthen the County’s abatement tools to address violent conduct or crime occurring within certain properties in the County which endanger the public health, safety and welfare of the citizens of the DeKalb County

FISCAL IMPACT:

None

RECOMMENDATION:

Recommended Action

To approve the above referenced addition to the Nuisance Ordinance of DeKalb County and to authorize the Chief Executive Officer to execute all necessary documents for implementation of the ordinance
