PURPOSE:
Henrico 183, LLC entered an Escrow Agreement with the County on August 9, 2022, and pursuant to it, an Escrow Agent is holding the sum of $1,500,000.00 made available for the County to potentially accept and then use by the County exclusively, as a separate, capital improvement budgeted item, in the design and construction of an inclusive park designed specifically to ensure that children and persons of all ages and abilities can play and interact together, to be located in south DeKalb County, in the DeKalb County park proposed to be named Michelle Obama Park (with the exact location to be determined by the County).
NEED/IMPACT:
Henrico 183, LLC, an affiliate of Blackhall Studios, entered into a Reciprocal Easement Agreement and an Escrow Agreement with the County. The Escrow Agreement was entered on August 9, 2022, and pursuant to it, an Escrow Agent is holding the sum of $1,500,000.00 made available for the County to potentially accept through the applicable adoption and approval process by the governing authority of the County, up until August 9, 2023. However, the parties extended the time for the County to accept the donation 9 different times to allow the litigation regarding the County's land swap with Blackhall to play out and conclude prior to accepting this donation. The latest extension moves the deadline for the County to accept the donation up until April 2, 2026, and further delay is no longer warranted.
FISCAL IMPACT:
No cost to the County, but the benefit of $1,500,000.00 for the expressly limited purposes stated above.
