Repeal of Monument Law as it Relates to County-Owned Property

Information Contact: Mereda Davis-Johnson, Commissioner District 5

Phone Number: 404-371-2159

PURPOSE:

To repeal state law which limits actions a county may take vis-à-vis confederate monuments owned by counties or located on county-owned property.

NEED/IMPACT:

Counties should have the authority and power to control what happens to monuments owned by a county or located on county-owned property. The governing authority of DeKalb County would support revisions to O.C.G.A. 50-3-1, which, allows counties to have control over such monuments.

This 1-22 Resolution replaces the one adopted by the Board of Commissioners on 1-19-2018 so it is clear that the County is not seeking a wholesale repeal of O.C.G.A. 50-3-1.  A clean and red-line version of the Resolution is attached so the changes can easily be reviewed.

FISCAL IMPACT:

No cost associated with this item.

RECOMMENDATION:

Recommended Action
