Resolution to Consider Abandonment of a 0.539 acre Section of Marshalls Industrial Drive Right of Way

PURPOSE:

To consider making a determination that a 0.539 acre section of Marshalls Industrial Drive has ceased to be used by the public to the extent that no substantial public purpose is served by said right of way. 

 

NEED/IMPACT:

The adjoining property owner has requested that 0.539 acre section of Marshalls Industrial Drive right of way be abandoned.  The subject property is zoned “M” and valued at $28,000.00.  Sale of the property would return it to the tax roll. The subject property is no longer needed for road purposes by DeKalb County; no substantial public purpose is served by its continued existence.  The County will reserve certain easements for water, sewer and fire infrastructure and for storm and surface water runoff.  The quitclaim deed shall contain a covenant requiring that any gate or barrier installed on the section of right-of-way proposed for abandonment comply with the requirements of the DeKalb County Fire and Rescue Department’s Gate Policy.

The County Attorney’s Office has reviewed the attached resolution and has approved it as-to-form.

 

 

FISCAL IMPACT:

There is no fiscal impact.

 

RECOMMENDATION:

Recommended Action

Adopt the attached resolution; and Authorize the Chief Executive Officer to execute all necessary documents in a form that is acceptable to the County Attorney.
