Resolution to Consider Abandonment of a 0.109 Acre Section of First Avenue Right of Way.

PURPOSE:
To consider making a determination that a 0.109 acre section of First Avenue has ceased to be used by the public to the extent that no substantial public purpose is served by said right of way.
NEED/IMPACT:
The adjoining property owner has requested that 0.109 acre section of First Avenue right of way be abandoned. The subject property is zoned “R-75” and valued at $10,900.00. Sale of the property would return it to the tax roll. The subject property is no longer needed for road purposes by DeKalb County; no substantial public purpose is served by its continued existence.
The County Attorney has reviewed the attached resolution and has approved it as-to-form.
FISCAL IMPACT:
There is no fiscal impact.
RECOMMENDATION:
Recommended Action
Adopt the attached resolution; and Authorize the Chief Executive Officer to execute all necessary documents.
