PURPOSE:

To continue multi-state legal actions related to the County’s water supply use of the Chattahoochee River as the source of the supply of water provided to customers.  Total Amount not to exceed $450,000.

 

NEED/IMPACT:

To perform work and legal research to carry out certain technical assistance activities whereas the States of Alabama, Florida and Georgia, and the U. S. Army Corp of Engineers are involved in disputes regarding the states respective water rights in the Apalachicola-Chattahoochee-Flint River Basin (the ACF Basin) and the Alabama-Coosa-Tallapoosa River Basin (the ACT Basin).  Failure to properly carry out this defense could result in significant changes or loss of the volume of water required by the County both now and in the future.  The Contract is multi-jurisdictional and needs to be executed by all parties to proceed.

 

FISCAL IMPACT:

Total Amount not to exceed $450,000.

Approval and authorization for the Chief Executive Officer to execute the contract (6 original copies) with the ARC for an amount not to exceed $450,000.
