PURPOSE:

To consider approving the attached application to the Georgia Department of Public Safety requesting a permit for the use of speed detection devices on DeKalb County streets.  

 

NEED/IMPACT:

Pursuant to O.C.G.A. § 40-14-2, law enforcement officers of the county may use speed detection devices for traffic control on DeKalb County streets only if the sheriffs of such counties or the governing authority of the county approves of and desires the use of such devices and applies to the Georgia Department of Public Safety for a permit for the authorization to use such devices.

Prior to the submission of the application to the Georgia Department of Public Safety, speed limits on streets or roads must be approved by the Office of Traffic Operations of the Georgia Department of Transportation. The attached list of speed zones was established based on engineering and traffic investigations as prescribed by law and was previously submitted to the Office of Traffic Operations of the Georgia Department of Transportation for their approval. 

Upon approval by the Board, the application will be submitted through the Georgia Department of Transportation to the Georgia Department of Public Safety for their approval and issuance of a radar permit to DeKalb County.  Once the radar permit is received, appropriate amendments will be required to the Code of DeKalb County, Georgia to comply with the new permit.  Those amendments will be submitted to the Board for approval at that time.

The current DeKalb County radar permit expires on December 31, 2019.  

                     Attachment (1) is the new permit, there are no changes from the current permit.
