PURPOSE:
To accept mitigation funds of $20,000 from A&R Ironworks, LLC and Arnworks Properties, LLC (Defendants) as part of a settlement with the Chattahoochee Riverkeeper, Inc (Plaintiff)
NEED/IMPACT:
The Recreation, Parks and Cultural Affairs Department is the recipient of a $20,0000 settlement in the matter of Chattahoochee Riverkeeper, Inc. v. A&R Ironworks and Arnworks Properties, LLC. Per the consent decree in this matter, the defendants are alleged to have violated codes of the Clean Water Act by discharging pollutants into Burnt Fork Creek, Peachtree Creek, and the Chattahoochee River. The RPCA Department will use the funds for the Naturalist Programs and Trail Systems located at Mason Mill Park. The project will include the procurement of environmental signage for the park.
FISCAL IMPACT:
No fiscal impact to the 2020 budget

To approve the resolution to accept mitigation funds of $20,000 from A&R Ironworks, LLC and Arnworks Properties, LLC and authorize the chief executive officer to execute all necessary documents.
