PURPOSE:
To consider authorizing the amendment of a November 17, 2009 agenda item and resolution requiring the sale of a 1.11 acre tract of surplus property at 4316 Church Street by sealed bid; and

To consider authorizing the sale of a 1.11 acre tract of surplus property at 4316 Church Street to the City of Tucker pursuant to O.C.G.A. ? 36-9-3(a)(3)(A), which allows the County to sell real property to another body politic.

NEED/IMPACT:
On November 17, 2009, the County declared the 1.11 acre tract of real property at 4316 Church Street surplus and required that the County's governing authority dispose of said property by advertising the property for sale to the highest bidder. The subject property has not been sold nor an auction conducted. However, O.C.G.A. ? 36-9-3(a)(3)(A) provides a specific exemption that allows counties to sell, transfer or convey real property to another body politic. The City of Tucker has offered to purchase, and the County is willing to sell, 4316 Church Street at its current market value.

FISCAL IMPACT:
The funds from the sale of 4316 Church Street would be directed to 2006 library bond projects.
