Authorize allowing the Georgia Department of Transportation (“GDOT”) to Construct Sidewalks along Lavista Road.

PURPOSE:

To consider authorizing the following to allow the Georgia Department of Transportation (“GDOT”) to construct sidewalks along Lavista Road: (1) the grant of permanent easements to GDOT on 3,392.15 square feet of County owned property at 2880 Lavista Road and 3,104.90 square feet of County owned property at 2890 Lavista Road; (2) the donation of 408.21 square feet of County owned property (.009 acres) in fee simple to GDOT pursuant to O.C.G.A. § 36-9-3(a)(3)(A), which allows County to sell or disposition of real property to another body politic; (3) Rights of Entry for County owned property at 2880 and 2890 Lavista Road to allow GDOT to begin work on the sidewalk project while all necessary documents are executed.  In exchange for the donation of property and grant of the easements, GDOT shall construct a driveway into Frazier Rowe Park.

 

NEED/IMPACT:

State law exempts the sale or disposition of another body politic from publication and sealed bid auction requirements.  The Georgia Department of Transportation is currently acquiring right-of-way needed for a sidewalk project on Lavista Road from Leafmore Place to Pangborn Road (PI#0015629).  As part of that project GDOT is seeking the donation of 408.21 square feet of County owned property (.009 acres) at 2890 Lavista Road (Parcel ID No. 18-148-01-061) and permanent easement on 3,392.15 square feet of County owned property at 2880 Lavista Road (Parcel ID No. 18-148-01-082) and 3,104.90 square feet of County owned property at 2890 Lavista Road (Parcel ID No. 18-148-01-061). GDOT is also requesting Rights of Entry to enter onto 2880 and 2890 Lavista Road to begin work.  This area is vacant swale area surrounded by existing road right-of-way. The donation of this property will assist GDOT in completing the project and provide better pedestrian access for citizens and park patrons along Lavista Road.

In exchange for GDOT’s construction of a driveway into Frazier Rowe Park, authorize the grant of permanent easements to GDOT on 3,392.15 square feet of County owned property at 2880 Lavista Road and 3,104.90 square feet of County owned property at 2890 Lavista Road; authorize the donation of 408.21 square feet of County owned property (.009 acres) at 2890 Lavista Road in fee simple to GDOT pursuant to O.C.G.A. § 36-9-3(a)(3)(A); authorize Rights of Entry for County owned property at 2880 and 2890 Lavista Road and authorize the Chief Executive Officer or his designee to execute all necessary documents to complete the donation of County property, Rights of Entry, and grant of easements, all in a form acceptable to the County Attorney or her designee.
