PURPOSE:
To consider the attached Resolution, Order and Declaration of Taking for the acquisition of a parcel of land (Parcel #42, Owner: Tommy Tuff) located within the boundaries required to complete Design Build Consent Decree Package Seven (7). The purpose of this Project is to meet Consent Decree requirements, update the county's sewer infrastructure and to reduce sewer spills.

NEED/IMPACT:
This condemnation will enable the County to include the subject property within Consent Decree - Package 7. Package 7 is necessary to complete critical sewer upgrades throughout the County. These upgrades and improvements will ensure compliance with the Federal Clean Water Act and the Georgia Water Quality Control Act and improves the viability of the County's sewer system.

The County Attorney has reviewed the attached documents and approves to form.

FISCAL IMPACT:
The total cost to DeKalb County, Department of Watershed Management is $1,173.00 (One Thousand One Hundred Seventy-Three Dollars and 00/100 to purchase the easement.
