PURPOSE:

DWM is requesting additional funding in the amount of $400,000 to the continuing the multi-state legal action related to the County’s water supply use of the Chattahoochee River as the source of the supply of water provided to customers by approving the Cooperative Technical Assistance Intergovernmental Cost Sharing Agreement between the City of Atlanta, the Cobb County - Marietta Water Authority, DeKalb County, the Atlanta - Fulton County Water Resources Commission, Gwinnett County and the Atlanta Regional Commission (ARC).

 

NEED/IMPACT:

To perform work and legal research to carry out certain technical assistance activities whereas the States of Alabama, Florida and Georgia, and the U. S. Army Corp of Engineers are involved in disputes regarding the states respective water rights in the Apalachicola-Chattahoochee-Flint River Basin (the ACF Basin) and the Alabama-Coosa-Tallapoosa River Basin (the ACT Basin).  Failure to properly carry out this defense could result in significant changes or loss of the volume of water required by the County both now and in the future.  The Contract is multi-jurisdictional and needs to be executed by all parties to proceed.

 

FISCAL IMPACT:

Funding: additional $400,000 Operation fund

 

RECOMMENDATION:

Recommended Action

Requesting approval for the change to agenda item 2022-1108 in the amount to $600,000 from $200,000 with the ARC for an additional $400,000.
