PURPOSE:

This proposed resolution requests the DeKalb County Law Department to provide guidance in the form of a report to the Board of Commissioners within 90 days of the adoption of this resolution, outlining the legal framework for creating a Commercial Property Assessed Conservation, Energy and Resiliency Development Authority (C-PACERDA).

 

NEED/IMPACT:

DeKalb County Government recognizes the importance of addressing climate change, promoting sustainability, and protecting environmental justice and in a continued effort to work toward DeKalb County’s goals for clean air and resiliency improvements, a Commercial Property Assessed Conservation, Energy, and Resiliency Development Authority (C-PACERDA) will be vital to ensuring the county meets our climate goals.

 

Short for Commercial Property Assessed Clean Energy and Resiliency, C-PACER Program allows owners of eligible commercial, industrial, agricultural properties and multifamily residential properties to obtain long-term financing from private capital providers for certain qualifying energy efficiency, renewable energy, water conservation, and resiliency investments.

 

The DeKalb County C-PACERDA’s purpose would be used specifically to facilitate the financing of energy efficiency and resiliency projects on commercial properties. To ensure the C-PACERDA meets all legal requirements and implications, it is crucial to include the DeKalb County Law Department in this development as they have expertise in legal matters and is best positioned to provide guidance on the creation.

Recommended Action

To approve the resolution to receive guidance by the DeKalb County Law Department on the creation of a County Commercial Property Assessed Conservation, Energy and Resiliency Development Authority and authorize the chief executive officer to execute any necessary documents.
