PURPOSE:
To accept and consider adopting a resolution to abandon a 13,317 SQFT (0.30-acre) section of right-of-way known as Lancaster Road that has ceased to be used by the public to the extent that no substantial public purpose is served by said right of way.
NEED/IMPACT:
The owner of property that abuts the referenced right-of-way sought to be abandoned, has requested a 13,317 SQFT (0.30-acre) section of right-of-way known as Lancaster Road to be abandoned and sold.
State law requires that a public hearing be held on a potential abandonment of right of way.
Notice of a public hearing has been provided to all property owners located thereon and notice has been published once a week for a period of two weeks pursuant to O.C.G.A § 32-7-2 (b)(1).
Proposed Public Hearing Date: March 26, 2024.
The County Attorney’s Office has reviewed the attached resolution and has approved it as-to-form.
FISCAL IMPACT:
There is no fiscal impact.

Recommended Action
Adopt the attached resolution related to potential abandonment of public right of way to be and authorize the Chief Executive Officer to execute all necessary documents.
