PURPOSE:
To consider a Petition requesting extension of the County’s sanitary sewer system for a portion of Bend Creek area located in city of Dunwoody, Georgia. If approved, construction will be programed for the installation of approximately 2400 linear feet of new 8-inch sanitary sewer pipeline system, and the designated area in the Bent Creek shall become a special tax district and properties within the designated area shall be assessed a portion of the cost of construction, $7,500.00 per property.
NEED/IMPACT:
The Bend Creek area is in Dunwoody, Georgia. A Petition has been submitted to the County to have public sewer installed in the Bend Creek area not currently served by public sewer. There are currently 22 properties that are not served by public sewer in the Bend Creek area. The Department of Watershed Management (DWM) staff has confirmed that there is available capacity in the system for the additional flow from Bend Creek area, as defined by DWM, includes the following properties: 1508 W Bend Creek Ct, 5601 W Bend Creek Way, 1510 W Bend Creek Way, 1520 E Bend Creek Ct, 5611 Bend Creek Way, 5555 Bend Creek Rd, 5537 Bend Creek Rd, 5525 Bend Creek Rd, 5515 Bend Creek Rd, 5570 Bend Creek Rd, 5558 Bend Creek Rd, 5550 Bend Creek Rd, 5540 Bend Creek Rd, 5528 Bend Creek Rd, 3599 Dunwoody Club Dr, 5724 Braddock Ct, 3577 Dunwoody Club Dr, 5717 Braddock Ct, 5711 Braddock Ct, 5708 Braddock Ct, 5714 Braddock Ct and 5577 Bend Creek Rd. In accordance with Chapter 25, Article IV, Division 2.5 of the Code of DeKalb County, as Revised 1988, a minimum of 51% of residents in the designated area must petition the County for sewer facilities in order for a petition to be approved. Fifty-four percent (54%) of the residents in the designated area (based on 12 signatures for 22 properties) submitted a complete Petition for sanitary sewer extension into the area. A public notice advertising the public hearing before the BOC ran in the Champion Newspaper for twenty (20) days prior to the hearing (published on September 28, October 5 and 12) and notice was mailed to the property owners in the designated area.
FISCAL IMPACT:
Project Estimate initial cost to County is approximately $1,920,000 (expect to recoup $165,000 from assessments). Funding Source - Line Item 73 of the DWM Renewal and Extension (R&E) Fund.
RECOMMENDATION:
Recommended Action
To approve the attached Petition and authorize the installation of approximately 2400 linear feet of new 8-inch sanitary sewer pipeline system in the Bend Creek area, authorize the creation of a special tax district for the designated area, whereby properties within the designated area shall be assessed a portion of the cost of construction, $7,500.00 per property, and authorize the Chief Executive Officer to execute all necessary documents.
